Website terms of use
1. Introduction
These Website Terms of Use explain the rules for using www.cunard.com including any subdomains (together, the "Site"). They apply to all visitors worldwide. By using our Site, you agree to these terms. If you do not agree, please do not use the Site.
2. Who we are
The Site is operated by Carnival UK Ltd. trading as Cunard ("we", "us", "our"). We are registered in England and Wales under company number 04039524 and our registered office is Carnival House, 100 Harbour Parade, Southampton SO15 1ST, United Kingdom.
You can contact us using the contact options shown on the Site.
3. Other terms that apply
These terms should be read together with: Passage Contract (if you book a cruise or vacation), and our privacy and cookie policy. If there is any conflict, the Passage Contract takes priority for bookings, then the privacy and cookie policy, and then these Website Terms of Use.
4. Changes to these terms and the Site
We may update these terms or the Site to reflect changes to our services, technology, or the law. We may update these terms from time to time and continued use after changes means you accept the updated terms. The version published on this page is the version currently in force.
5. Using our Site
You must use the Site lawfully and not harm, disrupt, or misuse it. You must not attempt to gain unauthorised access, interfere with security, or introduce malware. You must not use automated tools to scrape, extract or mine content or data from the Site, including for the development, training, fine-tuning or validation of AI systems or models, unless applicable law says we cannot restrict that activity in a particular case.
6. Accounts and security
Some parts of the Site may require you to create an account or use booking details. You are responsible for keeping your login details secure and confidential.
If we reasonably believe that your account has been compromised or misused, we may suspend or disable access.
7. Intellectual property
All content on the Site, including text, images, video, logos, branding, software and databases, is owned by us or our licensors and is protected by intellectual property laws.
You may use the Site and its content for your personal, non-commercial use only. You must not copy, modify, distribute or commercially exploit any content from the Site without our permission, unless the law allows it.
8. User‑generated content
Some parts of the Site may let you submit, upload, post or otherwise make content available, including reviews, photos, comments or other materials ("User Content"). You are responsible for any User Content you submit and must ensure it is lawful, accurate and does not infringe anyone else’s rights.
You confirm that you have the right to submit the User Content and to give us the rights set out below.
9. Rights in User Content
When you submit, upload, post or otherwise make any User Content available on or through the Site, you assign to us, by way of present assignment of existing rights and future rights, with full title guarantee, all right, title and interest in and to that User Content, including all copyright, database rights and any other intellectual property rights in any part of the world, for the full period of those rights (including any extensions, renewals and revivals).
To the extent that any such rights do not vest automatically, or cannot be assigned under applicable law, you grant us an exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable and sub-licensable licence to use, host, store, copy, reproduce, adapt, modify, translate, distribute, publish, display, perform and otherwise exploit that User Content in any media and for any purpose connected with our business.
You waive, and agree not to assert, to the fullest extent permitted by law, any moral rights or similar rights you may have in that User Content. If any such waiver is ineffective under applicable law, you agree not to enforce those rights against us, our group companies, licensees, assignees and successors in title.
You agree to do anything we reasonably ask (including signing further documents) to confirm, perfect or record our ownership of, or rights in, the User Content. You confirm that you have the right to submit the User Content and to assign or grant the rights set out in this clause.
10. Reviews
If the Site lets you submit or read reviews (for example, ship, cruise or port reviews), the rules below apply.
- Reviews must be based on the reviewer’s real experience. Please do not post anything that pretends to be a genuine review when it is not.
- If you received anything for writing a review (for example, money, a discount, a free or upgraded product or service, or any other benefit), you must clearly say so in the review. Reviews must not hide that they were incentivised.
- Reviews, and any star ratings or other information drawn from reviews, must not be presented in a way that misleads other users.
We take reasonable and proportionate steps to help prevent and remove fake reviews, reviews that hide incentives, and review information that is false or misleading. These steps may include moderation, automated checks, asking for supporting information, and removing reviews that do not comply with these terms.
We may remove or decline to publish reviews that breach these rules, ask you to amend them, or suspend accounts for repeated or serious misuse.
11. Links to other websites
We are not responsible for third‑party websites linked from our Site. These are provided for convenience only. We are not responsible for their content, availability or practices.
12. Availability and accuracy
We aim to keep the Site accurate and available but make no guarantees. Content is general information, not advice.
13. Liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Otherwise, to the extent permitted by law, we are not responsible for losses arising from your use of, or inability to use, the Site, or from reliance on content on the Site.
14. Privacy
We use personal information in line with our privacy and cookie policy.
15. General
We may transfer our rights and obligations under these terms to another organisation. You may not transfer your rights or obligations under these terms without our consent.
If any part of these terms is found to be unenforceable, the rest will continue to apply.
A person who is not a party to these terms has no right to enforce them.
16. Governing law
These terms are governed by the laws of England and Wales, although mandatory local consumer protection laws may also apply depending on where you live.
